Real Estate/Family Law

real estate law, title closing, purchase contract

WHY YOU SHOULD HIRE A REAL ESTATE ATTORNEY

Our real estate services are an area we would like to see you take advantage of.  The real estate industry is undergoing serious challenges, which make our services even more important to you.  We provide you all the services given by title companies, plus we do the following:

  1. Prepare the purchase contract
  2. Provide independent legal advice to obtain financing
  3. Resolve any title or inspection issues
  4. Give you legal advice throughout the transaction.

Hiring our law firm costs about the same as hiring a title company that cannot provide any of the aforementioned services as your closing agent.

Remember, paying for a closing agent and title insurance (if you get a loan) is not optional and you have the right to choose who your closing agent is. You are not forced to use who your realtor, lender, and/or mortgage brokers recommend to use for a closing agent. Call us with any questions; our first real estate consultation is free.

Divorce in Florida

The answer to every question is either A or B.  The parties either come to an agreement or you let a judge decide.

The most cost-effective route is an uncontested divorce.

Uncontested Divorce:  This is where the parties come to an agreement called a marital settlement agreement, which resolves all issues in the case.  This includes any issues of custody, child support, visitation, parental responsibility, assets and debts.  My approach is to contact the other side and work out an agreement without filing a lawsuit first.  When parties work together, the outcome is usually better with less animosity in the end between the parties.  This way I do not need to charge thousands of dollars in a retainer upfront.  You receive legal representation without going through the war and expense of litigation.  Litigation should always be the last resort, not your first choice.  Furthermore, only one court appearance is required for an uncontested divorce, which takes about an hour in total time.  The respondent in the divorce is not required to go, unless a restoration of name is requested.

Contested Divorce:  This is a litigation process that costs thousands of dollars.  This requires filing a lawsuit against your spouse and going through the full legal discovery process.  This requires tons of paperwork and costs to gather information about each other.  Moreover, there are costs in addition to attorneys’ fees, covering court reporters, transcripts, expert witnesses and everything the law allows you to do that can gather information.  This could require you to spend time away from work for depositions.  (This is a process in which a witness is asked questions under oath.)
